1. Description of the service
ElenaGiappone Scheduler (the “Tool”) is a private application developed and used exclusively by the owner to manage the owner’s own Facebook Page “ElenaGiappone”. The Tool allows the owner to publish and schedule the owner’s own content (text and images) on the Page and to read, moderate and reply to comments left by the public on that same Page.
The Tool is intended solely for the owner’s personal use. It is not a service offered to the public, it does not provide for the registration or access of third-party users, and it does not provide any functionality to other persons or organizations.
2. Permitted use
Use of the Tool is reserved exclusively to the data controller and owner of the Page. No third-party user is authorized to access, use or operate the Tool. The Tool is used only for the management of the owner’s Page, in accordance with the purposes described above.
3. No warranty (“as is”)
The Tool is provided “as is” and “as available”, without warranties of any kind, whether express or implied. There is no warranty that the Tool is error-free, always available, uninterrupted or fit for a particular purpose. Use of the Tool is at the owner’s discretion and under the owner’s responsibility.
4. Limitation of liability
As this is a private tool for the exclusive use of the owner, the developer assumes no liability towards third parties for any direct, indirect, incidental or consequential damages arising from the use of, or the inability to use, the Tool, including, by way of example, loss of data, failure to publish or service interruptions. To the extent permitted by applicable law, all liability is excluded.
5. Compliance with Meta/Facebook policies
The Tool operates through the official Facebook APIs provided by Meta Platforms. Use of the Tool is subject to and complies with the Facebook Terms of Service, the Platform Terms and the Meta Developer Policies. The owner undertakes to use the Tool in accordance with those conditions; in the event of any conflict, the Meta policies shall prevail.
6. Ownership of content
All content published or managed through the Tool (text, images and other materials) remains the property of the owner. The Tool claims no rights over such content and merely transmits it to the owner’s Facebook Page. Comments from the public remain the property of their respective authors and are processed solely for the purposes of moderation and reply on the Page.
7. Changes to the terms
These Terms may be updated at any time to reflect changes to the Tool or to regulatory obligations. The updated version is the one published at this address, indicating the date of the last update. Continued use of the Tool by the owner constitutes acceptance of the Terms in force.
8. Governing law and jurisdiction
These Terms are governed by the laws of Malta and, where applicable, by the law of the European Union. The courts of Malta shall have exclusive jurisdiction over any dispute relating to the Tool, without prejudice to mandatory provisions of law.

1. Descrizione del servizio
ElenaGiappone Scheduler (“lo Strumento”) è un’applicazione privata sviluppata e utilizzata esclusivamente dal titolare per gestire la propria Pagina Facebook “ElenaGiappone”. Lo Strumento consente al titolare di pubblicare e programmare i propri contenuti (testi e immagini) sulla Pagina e di leggere, moderare e rispondere ai commenti lasciati dal pubblico su quella stessa Pagina.
Lo Strumento è destinato unicamente all’uso personale del titolare. Non è un servizio offerto al pubblico, non prevede la registrazione o l’accesso di utenti terzi e non fornisce funzionalità ad altre persone o organizzazioni.
2. Uso consentito
L’uso dello Strumento è riservato esclusivamente al titolare del trattamento e della Pagina. Nessun utente terzo è autorizzato ad accedere, utilizzare o operare lo Strumento. Lo Strumento è impiegato solo per la gestione della Pagina del titolare, nel rispetto delle finalità sopra descritte.
3. Nessuna garanzia (“as is”)
Lo Strumento è fornito “così com’è” (“as is”) e “come disponibile”, senza garanzie di alcun tipo, esplicite o implicite. Non si garantisce che lo Strumento sia privo di errori, sempre disponibile, ininterrotto o adatto a uno scopo specifico. L’uso dello Strumento avviene a discrezione e sotto la responsabilità del titolare.
4. Limitazione di responsabilità
Trattandosi di uno strumento privato a uso esclusivo del titolare, lo sviluppatore non assume alcuna responsabilità verso terzi per eventuali danni diretti, indiretti, incidentali o consequenziali derivanti dall’uso o dall’impossibilità di usare lo Strumento, inclusi, a titolo esemplificativo, perdita di dati, mancata pubblicazione o interruzioni del servizio. Nei limiti consentiti dalla legge applicabile, ogni responsabilità è esclusa.
5. Rispetto delle policy di Meta/Facebook
Lo Strumento opera tramite le API ufficiali di Facebook fornite da Meta Platforms. L’uso dello Strumento è soggetto e conforme ai Termini di Servizio di Facebook, alle Platform Terms e alle Policy per gli sviluppatori di Meta. Il titolare si impegna a utilizzare lo Strumento nel rispetto di tali condizioni; in caso di conflitto, prevalgono le policy di Meta.
6. Proprietà dei contenuti
Tutti i contenuti pubblicati o gestiti tramite lo Strumento (testi, immagini e altri materiali) restano di proprietà del titolare. Lo Strumento non rivendica alcun diritto su tali contenuti e si limita a trasmetterli alla Pagina Facebook del titolare. I commenti del pubblico restano dei rispettivi autori e sono trattati unicamente ai fini di moderazione e risposta sulla Pagina.
7. Modifiche ai termini
I presenti Termini possono essere aggiornati in qualsiasi momento per riflettere modifiche allo Strumento o agli obblighi normativi. La versione aggiornata è quella pubblicata a questo indirizzo, con indicazione della data di ultimo aggiornamento. L’uso continuato dello Strumento da parte del titolare costituisce accettazione dei Termini vigenti.
8. Legge applicabile e foro competente
I presenti Termini sono regolati dalla legge di Malta e, ove applicabile, dal diritto dell’Unione Europea. Per ogni controversia relativa allo Strumento è competente in via esclusiva il foro di Malta, fatte salve le disposizioni inderogabili di legge.
