1. Description of the service

ElenaGiappone Posting (the “Service”) is a web-based publishing tool for content creators. The Service allows a creator to connect their own TikTok account, compose photo-carousel posts (cover, caption, privacy and interaction settings), preview them, and publish or schedule them to the creator’s own TikTok profile. The Service is designed to streamline recurring photo-carousel publishing for creators who maintain a consistent content calendar.

2. Accounts and authorization

To use the Service, a creator authenticates through TikTok’s official Login Kit and grants the permissions required to publish content on their behalf. Creators are responsible for maintaining the security of their TikTok account and for all activity carried out through the Service using their authorization. A creator may revoke access at any time from their TikTok account settings.

3. Acceptable use

Creators agree to use the Service only to publish content they own or are authorized to distribute, and in accordance with TikTok’s Terms of Service, Community Guidelines and all applicable laws. Creators must not use the Service to publish content that is unlawful, infringing, misleading, or otherwise in breach of TikTok’s policies.

4. Ownership of content

All content published or scheduled through the Service (images, captions and other materials) remains the property of the creator or its respective rights holders. The Service claims no ownership over such content and merely transmits it, at the creator’s explicit request and confirmation, to the creator’s own TikTok profile.

5. Compliance with TikTok policies

The Service operates through the official TikTok APIs, including Login Kit and the Content Posting API. Use of the Service is subject to, and complies with, the TikTok Terms of Service, the TikTok Developer Terms and all applicable TikTok platform policies. In the event of any conflict between these Terms and TikTok’s policies, TikTok’s policies shall prevail.

6. No warranty (“as is”)

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. There is no warranty that the Service will be error-free, uninterrupted, always available or fit for a particular purpose. Use of the Service is at the creator’s own discretion and responsibility.

7. Limitation of liability

To the extent permitted by applicable law, the provider shall not be liable for any direct, indirect, incidental or consequential damages arising from the use of, or inability to use, the Service, including, by way of example, loss of data, failure to publish, or service interruptions.

8. Changes to these terms

These Terms may be updated from time to time to reflect changes to the Service or to legal and regulatory obligations. The current version is the one published at this address, indicating the date of the last update. Continued use of the Service constitutes acceptance of the Terms then in force.

9. Governing law and jurisdiction

These Terms are governed by the laws of Malta and, where applicable, by the law of the European Union. The courts of Malta shall have exclusive jurisdiction over any dispute relating to the Service, without prejudice to mandatory provisions of law.
